A Utah district court has ruled the Utah Fits All scholarship program unconstitutional—jeopardizing education freedom for thousands of families. 

What we’re saying: 

“In Utah, families—not judges—know what’s best for their kids. This decision undermines the rights of parents, educators, and the very lawmakers who designed and passed this program. We are deeply disappointed, but encouraged by Gov. Spencer Cox’s commitment to appeal, and grateful to our partners at the Institute for Justice for defending the families now at risk because of this misapplication of the law.”

Why it matters: 

  • The Utah Fits All program empowers 10,000 families with flexible education scholarships.  
  • More than 27,000 applied to utilize the program—showing overwhelming demand. 
  • State lawmakers created and championed the program to ensure every child could access a learning experience that fits their individual needs. 

What’s next

  • A hearing is scheduled for Wednesday, April 23, at 2:00 p.m. MT. 
  • The court will decide whether to immediately block the program or allow it to operate during the appeal—impacting the 10,000 students currently enrolled and utilizing the program for the 2025–26 school year. 

The bottom line: 

This fight isn’t over. Utah families deserve options, and we’ll keep standing with them.
