This evening, the Kansas Senate joined the House in passing legislation to opt the state into the federal Education Freedom Tax Credit, positioning the state to expand education opportunity without changing existing state programs.

What happened:
The Kansas House passed SB 361 by a vote of 87–37, and the Senate has now followed with passage by a vote of 29–10. The bill now heads to the governor, with a veto proof majority.

Why this matters:
This is about making sure Kansas families are not left behind as other states move forward. Opting in allows Kansas scholarship organizations to prepare for participation in the federal program once it takes effect.

Kansas Republican voters overwhelmingly support policies that expand access to educational options, including both the federal tax credit and the state’s scholarship program.

What’s next:
The bill now awaits Gov. Laura Kelly.

What we’re saying:
“Today’s vote is a win for Kansas kids and the families who know them best. Lawmakers who supported this bill stepped up to make sure Kansas is ready to expand education opportunities and give more families the freedom to choose what works best for their children.”
–Shannon Pahls, public affairs director, yes. every kid.

Additional context:
Separate legislation, HB 2468, remains under consideration that would both opt Kansas into the federal program and expand the state’s existing tax credit.
